Research Paper the Maltese Falcon: Existentialism Essay

Dashiell Hammett, father of the American hard-boiled genre, is widely known for producing a suffocating world of realism in his works (â€Å"Hard-boiled fiction†). According to Paul Abraham’s â€Å"On re-reading The Maltese Falcon,† the realistic atmosphere of Hammett’s third novel is reactionary to the post-war turmoil in which the work was born (97). This provides the ideal foundation for subtle philosophical concepts of existentialism such as, quests for truth, self identification, and the significance of existence to build throughout the novel. Richard Layman, in his critical review of Hammett’s novel (also titled The Maltese Falcon), proposes that the philosophies of Hammett’s generation can be found within the text of his novel (71). Hammett conveys an existential theme in his work The Maltese Falcon through his use of themes of inquiry and self absorbed characters as well as his Flitcraft parable. Existentialism, in a simple form, is a philosophy concerning existence and its significance. Layman asserts that â€Å"[existentialism] had its roots in the mid-nineteenth century and flourished in the United States from the 1930s until the 1960s† (71). According to the web-article â€Å"World War I† from the New World Encyclopedia, subsequent to the Great War, â€Å"the optimism for world peace of the 1900s was entirely gone. † Therefore, without the blinders of social optimism, American society could question ideas such as, the occurrence of mass destruction in a â€Å"just† world and the significance of existence in such a world. Hammett’s firsthand experience with the existential crisis—caused by what the historical context from the website â€Å"The Maltese Falcon† presents as global wars, the Great Depression, and other struggles of the 1930s—leads Hammett to employ different techniques throughout his work, providing subtle allusions to existentialism. One method through which Hammett conveys existentialistic thought is through his themes of inquiry in The Maltese Falcon. The plot is centered on the continuous quest for an idolized icon—the Maltese falcon, a precious bejeweled bird. Hammett incorporates an ecclesiastical theme through this pursuit of an icon. The quest for their icon ultimately leads to the demise of the characters involved in its search. It steals the identity and climatically the life of the mob-boss Gutman. Brigid, the femme fatale, also loses in this pursuit, for she is left to the mercy of the law in the final pages. Whether death or imprisonment plagues the characters involved, the quest for an icon consumes their lives. Hammett illuminates the detrimental consequences of such quests through the aforementioned loss of identity, life, and freedom. This message is countered by the existentialistic denouncement of all icons. Existentialism provides a simple solution for such futile quests: lives are not wasted in the search of an icon. In pursuit of a precious icon, all characters lose themselves—a root of the existentialist crisis: loss of self, questioning of existence (â€Å"Existentialism†). Another theme of inquiry in Hammett’s novel deals with the constant search for the truth. Spade, the protagonist, is tormented by the ambiguity of truth throughout the novel. Spade is forced to discern lies from the truth within the first pages of the novel, where he meets Brigid, or rather â€Å"Miss Wonderly† as she is dubbed upon primary introduction. Brigid, notorious for her deceitful ways, confesses to Spade, once an invested relationship is established between the two: â€Å"I am a liar. I have always been a liar† (353). Layman observes that â€Å"the challenge for Spade in the book is to make up the rules as he goes along; to decide for himself, without outside guidance, what he believes and what he believes in† (71). These decisions shape Spade’s actions and help to define his character. Spade, concerning himself â€Å"with the quest for relevance and authenticity,† as David Pickus writes in his expose on existentialism, is not the only character involved in the search for truth (17). Brigid, Gutman, Cairo, and Wilmer are forced to come to terms with the quest for truth and authenticity when it is discovered their falcon is a mere fabrication of the true Maltese falcon. After shaving the black enamel from the base of the falcon Gutman exclaims â€Å"it’s a fake. † Gutman reacts with his â€Å"breath [hissing] between his teeth† and â€Å"his face [becoming] turgid with hot blood† (430). This is representative of the anger Gutman possesses upon the realization of this on-going search for authenticity. Another method in which Hammett unveils existentialistic undertones is through his self-absorbed characters. Layman writes about Spade: â€Å"He is defining who he is. That is the simplest statement of the philosophy of existentialism†¦Ã¢â‚¬ (71). Spade relies solely on himself and often stretches the hands of the law. He undermines the police in order to prevent interference within his investigations, denouncing their authority. For example, when Dundy, a police officer tells Spade, â€Å"You’ve gotten away with this and you’ve gotten away with that, but you can’t keep it up forever. † Spade nonchalantly replies: â€Å"Stop me when you can† (341). The article from the Philosophy website, titled â€Å"Existentialism† states that â€Å"an existentialist believes that a person should be forced to choose and be responsible without the help of laws, ethnic rules, or traditions. † Spade epitomizes this idea with his actions throughout the novel. Brigid is another character who does not function within the realm of laws and rules; however, she is a less responsible character than Spade. Brigid’s efforts are invested into self-preservation. She continuously fights to stay one step ahead of everyone through creating a web of lies, which ultimately becomes a defining element of her character. Her deceitfulness and obsession with obtaining her desires without concern for consequence or reputation demonstrates her loss of self in pursuit of something worthless; she becomes nothing more than a wanton woman with no true identity. In addition to his characterization, Hammett also utilizes the Flitcraft parable as a means of conveying existentialistic thought. Martin Harris writes: â€Å"The Flitcraft parable has been examined closely by those who see the story providing an important key to Hammett’s feelings about the meaning (or lack thereof) of human existence† (241). The Flitcraft parable tells the story of a man who completely changed his life in consequence of one random event. Flitcraft, a satisfied family man, encountered a near death experience via a construction beam plummeting into his path. This event made him contemplate the randomness of life—there are no certainties. Spade tells Brigid: â€Å"[Flitcraft] felt like somebody had taken the lid off life and let him look at the works† (335). Flitcraft understood the uncertainty of life after this experience. With this epiphany Flitcraft began a new life; he took the randomness of life and incorporated it into his existence. Aware of mortality and the significance of one’s identity, Flitcraft exposed himself to an alternate life. While Flitcraft ultimately ended up settling back into his prior lifestyle, the afterglow of his near death experience permitted him to revel in existentialism, for according to the web-article â€Å"Existentialism† the search of self-being is a fundamental element of the existential philosophy. Whether it is through various themes, characters, or a well placed anecdote, the undertones of existentialism exist within the pages of Hammett’s novel. Hammett effectively incorporated themes from his era into his literature. In a time where the â€Å"spirit of optimism in society was destroyed,† Hammett acknowledged realism within the text of his art (â€Å"Existentialism†). While existentialism no longer has an intoxicating hold on modern society, it lives in the pages of influential authors. The Maltese Falcon’s subtle cues to such great philosophical ideas assist in the significance that Hammett’s works hold to this day. Field Work and Data Collection Essay Example | Topics and Well Written Essays - 1750 words

Field Work and Data Collection - Essay Example 2.1 Methodology The methodology used in this study is a survey and relevant research. 2.2 Tool Used A questionnaire has been prepared and other relevant information will be obtained from different sources like journals, newspapers, magazines and articles. 2.3 Rationale of Questionnaire and Other Sources Used The research method that has been used in this study in order to achieve the above mentioned objective is a questionnaire (Appendix – 1). The questionnaire consists of 16 questions that are predominantly closed-ended in nature and it has been prepared for the participants who have the willingness to participate in the same. The main focus of preparing the questions mentioned in the questionnaire was to address the issue of prevailing economic scenario and how it has affected the people. In other words, the questions have been constructed to measure the effect of and related adjustments to the GFC. Closed-ended questions were preferred over open-ended questions because the questions could be easily categorised and is quantifiable (Bechman, 2005). Moreover, closed-ended questions can be analysed easily. ... The responses of closed-ended questions are more reliable and the turnaround time is less. It implies participants have to devote less time while answering the questionnaire and there is less chance of false replies being recorded (Seibert, 2002). The main objective of this questionnaire is to identify the responses of the questions based on this study. This would help in achieving the objectives of this study too. Hence, the main focus of the questionnaire is to find the impact of the present economic scenario on how people are spending their money, particularly in groceries. Whether people have changed from where they used to shop before and have shifted to discounted stores because of the recession or have they remained loyal to large supermarkets and the reasons behind such changes, are all addressed in the questionnaire. Hence, the questionnaire used as a tool in this study was quite effective in collecting data in quick time. It was also cost effective and large volume of data was gathered quite efficiently. A random sample selection procedure was used to design the sample and in total 150 responses was collected from people in the nearby local supermarket. 50 questionnaires each were distributed to Sainsbury, Tesco and Morrison shopkeepers respectively. Since the questions were closed-ended, people were comfortable answering the questionnaire. Moreover data collection was over in quick time because customers did not have to ponder over or think much before giving their reply to the questionnaire. The questionnaire that has been prepared is mentioned below. Proper justifications and the reasons behind asking such questions have also been explained. 1. Which grocery shop is preferred by you mostly? Sainsbury†¦..

International Developments That Have Critical Implication for Essay

International Developments That Have Critical Implication for International HRM - Essay Example A number of important international developments are presently taking place that has critical implication for international HRM. They include; (a) the growth of multinationals in the emerging markets, (b) constant increment levels of foreign direct investments, (c) the growing power of cross-border alliances (M&As) that involve companies from the emerging markets, (d) a growing trend in business process outsourcing, and (e) the challenges posed by the current financial crisis and the way to manage effectively in difficult times. The emerging international economic scenario characterized by the rise of economically stronger emerging markets is creating serious challenges for the IHRM policymakers; however, the same scenario lays immense opportunities for the IHRM researchers. The model of strategic international HRM (SIHRM) is based on the earliest and most famous article by Schuler, Dowling and De Cieri. The model describes endogenous and exogenous factors and strategic components th at have an effect on SIHRM policies, issues, functions, and practices. They, in turn, affect the MNC goals such as efficiency, learning, flexibility, effectiveness, responsiveness, and transfer. According to the model, the external factors (industry characteristics, country-regional characteristics and inter-organizational networks) have an effect on the internal organizational factors, strategic HRM and MNE (multinational enterprise) concerns and goals. The internal organizational factors, strategic HRM and MNE concerns and goals affect each other. The internal organizational factors include; (a) MNE structure – structure of the international operations, intra-organizational networks, mechanisms of coordination, and modes of operations, (b) MNE strategy – corporative level strategy and business level strategy, (c) experience in the management of international operations, and (d) headquarters international orientation. Strategic HRM entails HR function strategy and HR practices. MNE concerns and goals entail competitiveness, efficiency, the balance of local responsiveness and international integration, and flexibility.

Case 6-1 Coursework Example | Topics and Well Written Essays - 1000 words

Case 6-1 - Coursework Example ce of bank loans by the branch manager, the internal auditor, and perhaps the state regulatory authorities, should make sure that authorization does not extend to recording and documentation or custody of funds. These should be performed by different employees or officers. The auditors will make sure that the branch manager, being the head of the office, does not override the internal control system in order to commit fraud. It will also ensure that the branch manager does not exceed his authorized limit of loans he can extend without head office or committee approval. The branch manager had physical custody of the checks, or had complete, unchallenged access to them, relating to the transactions he had authorized (the release of the loans). He signed the checks (custodial function) in addition to authorizing the loans. The discharge of these two duties by the same person made it possible for the fraud to happen: This was obviously a violation of the principle of segregation of duties within the internal control system. Moreover, the power of the branch manager over hiring and firing, as well as evaluating performance and promoting the employees, also served as a deterrent to the employees to question anything that the branch manager would want to do. In other words, the branch manager, being the top supervisor who was ipso facto not directly accountable to anyone at the bank branch, had absolute control over what took place in his branch relative to any loan or financial transactions. The trust reposed by subordinates on their superior officer is an obstacle to the disciplined application of any management control system, hence there is a need for an independent audit at certain intervals. The internal auditor should make not only regular audits but also surprise audits on the branch and examine all transactions, check and reconcile all records, and interview the employees on the processes and procedures they actually followed in carrying out their

Heroes and Intellectuals Essay Example | Topics and Well Written Essays - 1000 words

Heroes and Intellectuals - Essay Example That is a question that haunts us all at some point in our lives. â€Å"Weve all got both light and dark inside us. What matters is the part we choose to act on. Thats who we really are.† (Rowling, n.d.) Those who choose the light are expected to fight for it at all times. However, is being a hero an obligation? It is really a choice. In essence, evil, obligation and heroism are separable in various circumstances and this explains the belief that no one has the obligation to fight evil whereas he/she puts the lives of the loved one in danger. This essay seeks to dissect various aspects relative to evil, obligation and intellectuality. The word evil is associated with all sorts of bad things which may endanger the lives of people in a society. The question as to whether some people who have the ability to fight evil can do so even if the lives of their loved ones is in danger is debatable. Whereas I agree that, those with ability in political, religious or economic arenas to fight evil for the sake of the numerous lives of the other members of the society other philosophers such as Rousseau (1999), argues that there should be values attributed to any kind of heroism. Rousseau (1999) asserts that heroism requires recognition of values and a cognitive decision to undertake the top most risk in the fight for the attainment or defense of such values. This explains that despite that fact that heroism can be attributed to an element of choice, the fundamentals includes cognizance of the values and the greatness of the danger. This belief can be counter argued that heroism can be justified not only by choice by necessity . For instance, if only one option to save a life exists then this is attributed to personal sacrifice. In cases where personal sacrifice is foremost and the only way, then there is no aspect of choice in this situation. This explanation disqualifies the belief that heroism is by choice, because there is a possibility of making a choice not to save

Is Suffering Good for Christians Research Paper

Is Suffering Good for Christians - Research Paper Example As a result, human beings are bound to suffer for the sins of their fathers. However, Jesus came to the rescue of human beings and throughout his mission alleviated the human beings from physical and spiritual suffering. Jesus suffered on behalf of the world and his close follower such as Peter followed the same path. Christian suffering today symbolizes their willingness to follow Christ and to draw closer to their creator. As such, the idea that prevails is that suffering is good for Christians as it is the bridge between them and God. Many religious scholars have come to link the concept of Christian suffering with the sin of man in the garden of Aden. In the Garden of Aden God, Adam and Eve live a life free of suffering prior to their sin against God. At the creation of the world, there was not any form of suffering such as diseases, accidents, death, poverty, or any other form of suffering. However, the sin of the first parents of man paved way for the entry of sin in the life of Man. On creating Adam, God ordered him to eat from all the trees and to benefit from every creation apart from the tree at the middle of the garden. The Serpent incited the couple to eat this fruit and the feel into the temptation only to realize that they had offended their creator. Disobedience of God’s command was the reason why they succumbed to suffering (Herion, Astrid, Freedman 23). Their life changes from a perfect life to one punctuated with lots of suffering for both man and woman. Most Christians have come to associat e their own suffering with that of their first parents Adam and Eve that was the result of disobedience. When Adam and Eve disobeyed God, He proclaimed punishment for their sins and this marked the beginning of suffering. For Adam, he condemned him to suffer by toiling for his daily living, working on barren land, diseases and all forms of suffering. For the woman, the lord proclaimed labour pain while bearing children. In addition, all human

Assignment - Essay Example I for instance understand the importance of the type of communication to be made in writing. This is because of existence of different types of written communications that requires different approaches, formats, and formalities. A written communication also has to exhibit a high level of clarity to ensure efficient and effective message delivery to the recipient. This is because a clear message relieves the audience of possible strains in decoding and understanding the message and reduces chances of the message being neglected by the recipient. My skills in written communication also include the knowledge that such communications should be as short as possible to facilitate clarity of message. A written communication should also have an appropriate tone that considers the audience, and should be free from mistakes. An example of a written communication is in communication of an organization’s financial position to a potential investor (Guffey and Loewy, 2012). Enjoying Horror Research Paper Example | Topics and Well Written Essays - 500 words

Enjoying Horror - Research Paper Example This implies horror film viewers are happy with the frightening scenes, a tendency that becomes habitual making most people prefer watching them once they are free. In addition, Sine contends people tend to develop strong urge for watching terror that characterize these films due to the thrill of seeing abnormal termination of life or undertaking of certain risky ventures. The latter aspect, which Sine contends is the disclosure of horrific existence acting as the only source of excitement to the viewers. For instance, the torture unleashed on victims, which fascinates viewers, compared to their interests of knowing the movie’s story line or its end. He also claims it is not the tragic events that invoke pleasure among horror viewers but the way the whole situation is associated with our real life situation (Sine, n.d). Numerous people deem horror movies are harmless without knowing immense fascination enjoyed by viewers is equal to adverse affects inflicted on them especially to the young people who may end up doing what they see in real life. The author claims, â€Å"These impacts are felt by adults as well as children, by the well-adjusted as well as the disturbed† (Sine, n.d). This is because the effects usually linger in the minds of many viewers, hence haunting them throughout their lives. The article â€Å"The critique of pure Horror† authored by Zinoman Jason generally relays reasons why people find pleasure in watching horror films. In this article, Zinoman claims different writers aim at invoking a sense of curiosity among viewers via using both suspense and fascination created by human-like monsters. He contends, â€Å"The pleasure of horror movies is due not to whatever psychic substratum the monster represents, but rather to the peculiar curiosity it inspires† (Zinoman, 2011). Contrary to Sine, Zinoman highly appreciates the emotional aspects characterizing

Report Education System in Japan Essay Example for Free

Report Education System in Japan Essay Japan has already begun to experience a population decline, with the result that many universities are already having difficulty maintaining their student populations, although entry into top ranks of the universities remains hugely competitive. The emerging and foreseeable trend is that many universities will have to try to attract large numbers of foreigners or diversify or face closure. It is also now said that a university education in Japan is within easier reach of students today, but that the quality of that higher education is now in question despite the many educational reforms that have been set in motion. Each academic year begins in April and comprises of two semesters. Basic general degrees are four-year degrees, a feature adapted from the American system. Undergraduate students receive instruction via the lecture and seminar group method. The general degree may be followed by two-year Masters degrees (generally a combination of lectures and guided research) and then a three year Doctorate (largely based on research) where these are offered. Graduate education in Japan is underdeveloped compared to European countries and the United States with only slightly more than 7 percent of Japanese undergraduates going on to graduate school as compared to 13 percent of American undergraduates. Postgraduate educational offerings are weak and the number of universities offering postgraduate programmes or a wide variety of programmes, is small, compared to that in other industrialized western countries. Japan has about three million students enrolled in 1,200 universities and junior colleges and consequently the second largest higher educational system in the developed world. Japan also has one of the largest systems of private higher education in the world. The 710 odd universities in Japan can be separated into 3 categories: highly competitive, mildly competitive and non-competitive (the schools that are first-tier being the infamously difficult to enter ones). Public universities are generally more prestigious than their private ones with only 25 percent of all university-bound students being admitted to public universities. More than 65 percent of high school graduates continue their studies; of these, over 70 percent are enrolled in private colleges and universities. Only about 10 percent of private institutions receive their financial resources from public funding, with most public funds on higher education being spent on the national and local public universities. Despite the impressive statistics, Japanese universities are considered to be the weakest link in the countrys educational system. While many western writers have, time and time again, attributed the economic success of Japan to the well-educated and highly literate population of Japan, recent writings and studies tend to be far more critical, lamenting the deplorable state and quality of higher education in Japan today. Despite the famed exam rigors and competitiveness, declining standards in education and the high school students lack of interest in studying have lately been under spotlight. Some attribute this disinterestedness to the fact that academic effort no longer assured automatic rewards with the disintegration in the formerly stable and guaranteed lifetime employment system. Japanese students are also widely known to traditionally consider their university days to be a social playground, a reward for the hard work and having made it there, and, as many critics have recently pointed, professors demand relatively little from their students. Despite the institutional change and sweeping national reforms underway in response to these criticisms, the key problems remain unresolved: the pyramidal-structure of the university system and entrance exam wars; the centrally-controlled curriculum and lack of individuality and creativity of students as well as the lack of competitiveness in educational suppliers.

Book Review on Fat Girl Essay Example for Free

Book Review on Fat Girl Essay Book Review Obesity is an upcoming and extremely prevalent phenomenon in America today. Author, Judith Moore of the book â€Å"Fat Girl† discusses some of the issues fat girls face. Her book is less about every stereo-typed fat girl and more about her story individually. Judith Moore chooses to take a different route, instead of complaining continuously about being fat, she explains in depth why she believes she is fat. She is not lazy; she expresses her knowledge of diets and her experiences of strenuous work outs but ends with little to no results. My flesh resists loss. My fat holds on for dear life, holds on under my bratwurst arms and between my clabber thighs. Food is a fuel, but to some food may be a pain reliever. For Judith, she had to face an unhappy family life early on. Judith had always been a fat girl and her father a fat man weighing close to 300 pounds. Her family was secluded and each individual only cared for themselves. Clearly her family was an unhappy one; they used food as source of pleasure and hoped it would cure the pain. At the age of four, Judith’s parents divorced. After the divorce, Judith was shipped back and forth between her mom’s mother’s farm and her mom’s apartment in Brooklyn. These trips back and forth only created more emotional scaring for Judith. Her Grandmother had a strong hatred for her father, and being that Judith was a spitting image of him, she received the backlash. Grandma fed Judiths needs literally and figuratively speaking. Each time she visited her Grandmothers farm she was fed extremely fattening comfort foods, and with that she grew larger. Her Grandmother would make comments over how large she was and how she was growing, breaking her down each time. This led to Judith’s reach for food to fill the hole created by her dysfunctional family. The love of food steamed from her unloving family. Her continuous pattern of eating to fulfill an emotional need led to Judith’s weight gain. Judith proceeds to explain more emotional traumatizing events in her life that are male influenced. She discloses information that a man once told her she was too fat to get in bed with, and her experience of being manipulated into giving oral head to a man who she thought was a kind person, while his friends watched and laughed. Not once throughout her book did Judith play the victim for being fat. Because Judith proceeds to tell the readers events in her life and why they make her who she is today, this book consider would be considered an autobiography. The book gives another perspective on another persons’ life. Judith’s obvious intention for this book was not to complain about being fat, but to state the events of her life that made her who she is. She did not stereo-type every fat girl, she simply told her story and ways other fat girls could relate. This autobiography presents an issue of correlation with our society and obesity. It suggests that obesity can come from emotional pain or distress. I would suggest this book to my friends, it explains that everyone has a story of why they are the way they are.

Common And Civil Law Legal Systems Law Essay

Common And Civil Law Legal Systems Law Essay In general, law is set of general rules, regulations and principles accepted in some community and to applicable only in its territory, which is written by legislative authority. There are a lot of functions of law in the society and business. Some of the roles of the law are to keep the peace, shaping the rules of conduct and moral standards, promoting social justice and individual freedom, facilitating planning and orderly change and also protecting the environment. Law has been developing through many centuries and always changing according to the communitys social life, traditions and moral principles. Nowadays there are as many legal systems as many number of countries in the world. However all countrys over the world developed and incorporated their own laws based on three main types of legal systems such as Civil law (Continental law), Common law and Religious (Islamic) law. All these three legal systems have their own features and histories which helps us to differentiate and learn easily. In this essay I am going to discuss two main legal systems Common and Civil Law Legal Systems and their criminal and civil procedures. Common Law Legal System Common Law Legal system is one of the most famous and widespreadly used system in the world.  [1]  En.wikipedia.org (2010) suggests that This system was originated from England in the Middle Ages and very common source of a lot of Western and Eastern countries such as United States of America (except Louisiana where English criminal law combined with French civil law), England, Ireland, Canada, Pakistan and Singapore which were colonized by British Empire. The main feature of the Common Law Legal System is that compare to other legal system the Judge is the main authority. . In this legal system the principles and rules of action based on decisions of courts made by judges and similar tribunals (similar cases) to decide future cases, rather than codified rules and legislations. Common law system these similar cases called as a precedent. The precedent which is might be applied to solve some problems is called as a binding precedent or mandatory precedent. Sometimes Judges in orde r to solve some cases uses not the exactly same precedents, but similar or precedents with some relevant information, such type of precedents called persuasive precedents. In some practical cases common law system is not ideal system to use, sometimes some controversial or more considerably complicated features may occur. Moreover, in Common law the decisions of the judge or court only compulsory within particular jurisdiction and some courts have more authority than others. The weight of court decisions also makes Common law different from Civil law system. By contrast, in civil law jurisdictions judge has more self-determination to interpret the given codification rather then predictability like common law system judges. Civil Law Legal System Civil (Continental) Law is a modern legal system originated by Roman law especially the system is derived from Code of Justinian, (during the Middle Ages the emperor Justinian played an important role on the development of the Civil Law System) as later developed by legal scholars later. This system is the most ancient and common legal system in the world. The main and unique feature of the Civil law is that it is collection of written and codified rules in the form of civil codes which are applied and interpreted by judges.  [2]   Criminal Procedures in Common and Civil Law Legal System Common Law and Civil Law Legal systems differ considerably in criminal procedure and civil procedures. Although some systems, including the Common legal system, let private individuals to bring a criminal prosecution against others, prosecutions are nearly always started by the state, in order to punish the defendant. However Civil law legal actions are started by private individuals, companies or organizations. The cases are usually in different courts, and juries are not commonly used in civil cases.  [3]   In both Common and Civil law systems the criminal procedures are significantly varies than in civil law systems. In criminal cases the government will be against the individuals the prosecutor will be on the sight of government and will protect the rights of the victims (society or government) and also in lower case actually the jury will be employed. In criminal procedures as a solution to the case Judge can decide the person who made crime to some sentence, such as fine, jail or time. In the next following sentences there is given how the criminal procedure will be taken in Common law legal systems according to the David Carnes: Prosecution Although a criminal defense lawyer is obligated to advocate the defendants interests, a prosecutor is obligated to seek justice even if it means refusing to charge or convict a defendant. Because of this, the decision of whether to prosecute rests solely with the prosecutor. Although most prosecutions are commenced in response to an arrest by the police of the filing of a criminal complaint by the police of a private citizen, a prosecutor has the authority to initiate prosecution unilaterally. Bail Bail is a sum of money that the defendant must pay to remain free between the bail hearing and the conclusion of the trial. The purpose of bail is to give the defendant a motive to show up at trial (in order to get the bail money back). Judges can set bail higher or lower depending on their estimate of how likely the defendant is to show up at trial. In many cases, bail is denied. Plea Bargaining A plea bargain is a written agreement in which the defendant agrees to plead guilty to a lesser charge, in exchange for which the prosecutor will recommend to the judge that the original charges be dropped and that a previously agreed upon sentence be imposed. The judge does not have to accept the prosecutors recommendations. Prosecutors are willing to plea bargain when they face busy trial dockets, and when the available evidence raises doubts about whether the defendant will be eventually convicted. Trial Practice Trials in common law countries are adversarial, meaning that the prosecution and the defense initiate almost all action while judges are relatively passive, acting as referees. For example, if the prosecution attempts to admit evidence that should be excluded under the rules of evidence, the evidence will normally be admitted anyway unless the defense objects to its admission. In this case, a convicted defendant may appeal on the basis that he received ineffective assistance of counsel. Although every criminal defendant is entitled to demand to be tried by a jury, if no demand for a jury trial is made then the judge will determine guilt or innocence. Sentencing Regardless of whether or not a jury is empanelled, the judge will determine the sentence (within statutorily defined ranges) if the defendant is convicted. The defendant is entitled to present evidence, such as good prior behavior or mitigating circumstances, that may convince the judge to imposed a lighter sentence.  [4]   Continental Legal Systems is the fundamental source of the Civil Procedure. It mainly refers to the civil law takes into account almost all the cases not related to criminal issues the laws almost all the cases which is not related to criminal issues such as business, estates, legal contracts, accidents and domestic issues and intended to protect individuals liberties and civil rights. Civil procedure refers only to the procedures, not the laws. In Civil procedure the role of lawyers are very important and it is specialized area of to practice them. However civil law and criminal law may overlap each other. In such cases the problem will be judged under both criminal and civil procedures. For instance, if the bus driver hits the people walking on the street and kills that person he can be tried in criminal court for killing the innocent people and the victims family members be able to give him to the court for the same case under the civil procedure. Conclusion In conclusion, I would like to state that law is very controversial and very complicated subject to learn. How deep you learn it you will discover more questions to answer. Sometimes you can discover such laws which can overlap each other.

Teen Pregnancy Children from homes run by teenage mothers have to face almost insurmountable obstacles in life. The incidents of depression and mental health problems, the lack of father figures, and the high rate of poverty often connected to children in homes run by teenage mothers put them at serious disadvantages when compared to children raised in nuclear families. Gender Relations in Chinua Achebes Things Fall Apart Essay -- Things

Gender Relations in Chinua Achebe's Things Fall Apart      Ã‚   In Chinua Achebe's novel Things Fall Apart, the Ibo people's patriarchal society has a strict system of behavioral customs according to gender. These customs strongly restrict the freedom of Ibo women and help to reinforce generation after generation the notion that Ibo men are superior to the women of their tribe.    Among the people of this society, the condition of weakness is strongly associated with the state of being female. The worst insult that a man can receive is to be called a woman. The novel's main character, Okonkwo, is often obsessed with proving his strength as a man because he seeks to escape the reputation of his father who was considered by his fellow clansmen to be weak like a woman. He is ashamed when he learns that "agbala was not only another name for woman, it could also mean a man who had taken no title" when this insult is applied to his father. Okonkwo takes the insecurity of his manliness to extremes, and even unnecessarily kills the adopted son whom he loves deeply in order to prove his unwavering emotional fortitude. "Dazed with fear, Okonkwo drew his machet and cut him down. He was afraid of being thought weak."(43)    In Ibo culture, it is practically a disgrace to be born a female. This attitude is apparent in considering the emphasis placed on women to bear sons in order to carry on the honor of the family. When a woman had borne her third son in succession, her husband "slaughtered a goat for her, as was the custom."(56) A woman is honored only if she could "bear... sons"(82) to carry on a great family's name and honor.    Okonkwo is greatly disappointed by the tendencies of his offspring in their gender roles. H... ... physical power that they can exercise. Although this oppression is deplorable from a modern North American standpoint, from the point of view of the Ibo women of this period it is quite acceptable and none of them feel any necessity to change their social system.    Works Cited Achebe, Chinua. Who Holds Power in the United Kingdom Today Essay -- Papers

Who Holds Power in the United Kingdom Today To approach this question it is essential to consider both the definitions of power and the various different domains within which they work. As power is central to the understanding of politics, it evokes fierce controversy over its meaning. Academics have argued that politics strives to resolve conflict by producing consensus over the issues in question. In contrast, the practice of politics may also be seen solely as a means of execising power, be it through particular coercive forces or a legitimate authoratitive body. Political activity is omnipresent, existing on both micro level (as seen in the relationship between teacher and student) and on a macro level, meaning the state. Consequently, this brings us to make a necessary distinction between 'power' and 'influence'. The former can be seen as an ability to make significant political decisions which facilitates the control over others. e.g.the power of government over society. In contrast, the latter implies the potential to transform any component part of these decisions via some form of external pressure. For instance, this may include anything from rational debating within Parliament, to open intimidation such as armed police forces. Liberal democratic politics dictate the political agenda of the British political system. The 'liberal' element advocates the support for a multitude of different networks within the state as well as a number of different groups working seprate from the state. For example, N.G.Os, a Bill of Rights, an autonomous judiciary and finally, a complex system of 'checks and balances' within the in... ...mocratic, by implication we must live under the rule of a state elite. And if it is the case that such an elite must strive in every way possible to promote big business in order to uphold social cohesion, then surely it is impossible to deny that capitalist interests are the basis of all governmental decisions. It would only be logical to conclude that the concept of who holds power in the U.K today is merely a guise with government being a necessary shadow passed over society by the interests of big business. The reason this stlye of government has endured for so long is perhaps mans neccessity to believe that he has some control over his own destiny or as Thomas Paine so eloquently put it in the "Rights of Man" (1789), "Society is in every state a blessing, but, government in its best state is but a necessary evil".

About Type 2 Diabetes Essay

Around 2.6 million people in the UK have been diagnosed with diabetes. About nine in 10 of these people have type 2 diabetes. It usually affects people over the age of 40, but can develop at any age. People of African-Caribbean or South Asian origin are more likely to develop type 2 diabetes. It usually affects them earlier in life, from about the age of 25. Type 2 diabetes is becoming more common, particularly in children. Type 2 diabetes develops when your body can’t produce enough insulin or if your body doesn’t respond to insulin as it should. Insulin regulates the level of glucose in your blood. Glucose is a simple form of sugar found in foods and sugary drinks. It’s absorbed by your body as a natural part of digestion and is carried around your body in your blood. When glucose reaches your body tissues, such as muscle cells, it’s absorbed and converted into energy. Insulin is secreted into your blood by your pancreas, which is a gland located behind your stomach. If your cells don’t respond properly to insulin, it can cause glucose to build up in your blood. This is called insulin resistance. If this happens, your pancreas needs to produce more and more insulin to overcome the resistance and control your blood glucose levels. Types of diabetes There are two main types of diabetes: type 1 and type 2. There are about two million people in the UK who have diabetes. Type 2 diabetes is the common form, affecting nine out of every 10 people with diabetes. Symptoms of type 2 diabetes Many people with type 2 diabetes have no obvious symptoms. It’s often discovered during a routine medical check-up with your GP.If you do have symptoms of type 2 diabetes, you may: †¢pass more urine than usual See more: My Writing Process Essay †¢be constantly thirsty †¢have unexplained weight loss †¢be extremely tired †¢have blurred vision †¢have itchy skin around your genitals or get regular infections, such as thrush †¢notice that wounds such as cuts heal slowly If you have any of these symptoms, see your GP. nitially, some people find they don’t have any symptoms. So if you think you may be at risk of type 2 diabetes, speak to your GP about having a screening blood test.  Complications of type 2 diabetes If type 2 diabetes isn’t diagnosed or controlled properly, you can develop blood glucose levels that are either too high (hyperglycaemia) or too low (hypoglycaemia). Hyperglycaemia If type 2 diabetes is poorly controlled or you get an infection, glucose can build up in your blood and rise to high levels. This can cause you to: †¢be thirsty †¢pass urine excessively †¢have blurred vision †¢feel tired Very rarely, if you become dehydrated and your blood glucose rises to very high levels, you can develop a condition called hyperosmolar hyperglycaemic state. This can cause you to become drowsy and potentially unconscious. Hyperosmolar hyperglycaemic state is a medical emergency and needs to be treated in hospital. In the long-term, uncontrolled high blood glucose levels can increase your risk of: †¢kidney failure †¢blindness †¢nerve damage †¢heart disease †¢stroke Hypoglycaemia Sometimes, if your medication is too strong or you miss a meal, your blood glucose levels can become too low (hypoglycaemia). This only happens if you’re taking certain medicines such as gliclazide (or others of the same type), repaglinide or insulin (of any type). If your blood glucose is low, you may go pale, feel sweaty and become confused. If you develop hypoglycaemia, it’s important to eat or drink something containing glucose, for example fruit juice or some sweets. Causes of type 2 diabetes There are several risk factors that make you more likely to develop type 2 diabetes, including if you: †¢are overweight or obese – in particular, if you’re an ‘apple shape’ with lots of fat around your abdomen (tummy) †¢have a close family member with the condition †¢are of African-Caribbean or South-Asian origin †¢are over 40 – your risk increases with age †¢have high blood pressure or have had a heart attack or stroke †¢don’t exercise regularly †¢have severe mental health problems †¢are a woman and have polycystic ovary syndrome and are overweight †¢are a woman and have had diabetes that developed during pregnancy (gestational diabetes) If you have a condition such as impaired glucose tolerance or impaired fasting glycaemia, this means the level of glucose in your blood is naturally higher than normal and you’re more likely to develop type 2 diabetes. Diagnosis of type 2 diabetes Your GP will ask about your symptoms and examine you. He or she may also ask about your medical history. You may need to have some of the following tests. †¢Urine test. You will need to give a sample to be tested for glucose. †¢Fasting blood glucose test. You will have a sample of blood taken from your arm to test for glucose. You will need to fast overnight before having this test. You may have this with a glycosylated haemoglobin (HbA1C) test. HbA1C is a protein that is produced when you have high blood glucose levels over a long period of time. †¢Glucose tolerance test. This may be needed if your fasting blood glucose test is borderline. It measures how your blood glucose level changes over time after you have a sugary drink. You will need to fast overnight before having this test. Treatment of type 2 diabetes There isn’t a cure for type 2 diabetes but it can be controlled. Some people can control their condition with lifestyle changes alone. Others need to take medicines or use insulin injections. Self-help By making the following lifestyle changes, you can help control your blood glucose levels. †¢Eat a healthy balanced diet with regular meals, three times a day. Include carbohydrates, such as pasta or potatoes in each meal. †¢Aim to do 150 minutes of moderate exercise over a week in bouts of 10 minutes or more. This will help you to stay a healthy weight and control your blood glucose levels. †¢Only drink alcohol in moderation and stick within the recommended limits. †¢If you smoke, give up. Smoking is unhealthy for everyone, but it’s especially important to stop if you have diabetes because you already have an increased risk of developing circulatory problems and cardiovascular  disease. Oral medicines If lifestyle changes alone don’t keep your blood glucose levels under control, you may be prescribed medicines. Some examples are listed below. †¢Metformin works by reducing the amount of glucose that gets released into your bloodstream from your liver. It also improves the way glucose is used by your muscles. †¢Gliclazide, glipizide, glimepiride and tolbutamide help your pancreas to produce more insulin. †¢Repaglinide and nateglinide also help your pancreas to produce more insulin, but work more quickly and last for a shorter time. †¢Acarbose lowers your blood glucose by slowing down the rate at which some carbohydrates are absorbed by your body. †¢Pioglitazone reduces your body’s resistance to insulin. †¢Sitagliptin, saxagliptin and vildagliptin help your body to produce more insulin at mealtimes. These medicines are usually taken between one and three times a day. Injections You may be prescribed other medicines such as exenatide or liraglutide. These medicines are given by injection and work by helping your body to make more insulin when it’s needed. They can also reduce your appetite and help you lose weight. If lifestyle changes and medicines can’t keep your blood glucose levels under control, you may need to have insulin injections as well as, or instead of, tablets. You will usually inject yourself with insulin once or twice a day, using either a small needle or a pen-type syringe with replaceable cartridges. There are several different types of insulin that work at different rates and for different lengths of time. Ask your GP for advice on which type is best for you. If you have insulin injections, you will need to monitor your blood glucose levels with a home test kit. This involves taking a pinprick of blood from your finger and putting a drop on a testing strip. A meter will read the result automatically. Your GP or diabetes specialist nurse will show you how to monitor your blood glucose levels and tell you how often you need to check it. Monitoring your blood glucose level You may also need to have your levels of HbA1C tested at least twice a year. The test is done by taking blood from a vein in your arm or sometimes a drop of blood from a fingerprick. It’s used to see how well you’re controlling your blood sugar  levels.
